Genki Responds to Nintendo Lawsuit Over Switch 2 Replica

Accessory maker Genki has issued a public statement after being hit with a lawsuit from Nintendo over alleged trademark infringement related to the upcoming Nintendo Switch 2. The dispute began earlier this year at CES 2025, where Genki reportedly showcased what it called an “exact replica” of the unannounced Switch 2 behind closed doors.

Nintendo, which denies ever sharing design details or specs with Genki, quickly intervened. Its legal team confronted Genki at CES, prompting the company to shut down its booth a day early. Following that incident, Nintendo filed a lawsuit in the U.S. District Court in California, accusing Genki of unauthorized promotion and use of its trademarks.

In a statement posted to Twitter, Genki said it is taking the lawsuit seriously and is working with legal counsel. The company emphasized its commitment to creating innovative gaming accessories and added that it cannot comment further due to ongoing legal proceedings. Genki also noted its preparations for PAX East remain underway.

Nintendo, known for aggressively protecting its intellectual property, has been pursuing multiple legal actions recently. Aside from Genki, the company is also involved in cases against hackers, modders, and a streamer who allegedly played unreleased Switch games online.

What the future holds for Genki is unclear. Nintendo is reportedly seeking to block the sale and promotion of Genki’s Switch and Switch 2-related products — a potential major blow to the accessory maker as the next-generation console approaches launch.
